when you plug it into the computer, itunes should come up. if you don't have itunes you should download it. you can put you cds into the computer and it will rip it to your itunes library. then sync your ipod touch.
If Windows Seven came together with your computer, yes it will come with it. If not, you will get that OS which you paid for. They do not upgrade it, especially for free.
one time i had the same problem so i updated the to the newest version of itunes. it takes an hour or so to download, and then it started working. if that doesnt work for you then i would call a computer guy to fix it
