Under US law, a person charged with a crime is considered innocent by the court until such a time that a case has been proven beyond a reasonable doubt against them (that's reasonable doubt, not beyond a shadow of a doubt). The case is currently being presented to a jury (May through July 2011 approximately) and the cause of the child's death was never determined. How the child died is not the matter being decided at trial, only if Casey Anthony deliberately killed her or that the child died accidently from an act of child abuse.
Update:According to a jury of her peers, she was pronounced not guilty in the death of her daughter on July 5, 2011.When Caylee Anthony's remains were found on December 11, 2008, the body had already decomposed completely and an autopsy could not determine a cause of death. Because the child had not been reported missing by her mother; and the remains were found stuffed in bags in a swampy, wooded area; and there was Duct Tape wrapped around the skull, it was determined that the child was murdered or that she had died as a result of child abuse.
The exact means of the child's death could not be determined so we can only assume. There was clear evidence that some sort of drug was used on the child to anesthetize her leading to the assumption that mommy wanted her to be quiet while mommy did her thing. At some point, the child's face was wrapped in duct tape; it is unknown whether that happened while the child was alive, alive and anesthetized, or had already died. It is assumed by the many professionals involved that one of these occurrences or a combination cause the death of Caylee.
Since it could not be proven that the abuse was inflicted by Caylee's mother; and since Casey Anthony refused to provide any information that could lead to another suspect, her silence makes her an accomplice if anyone else was involved; which is highly unlikely, since the investigation was extremely thorough, that anyone else was involved.
As far as I know, Casey Anthony did not have a criminal record before the death of Caylee.
