According to the Constitution, the House of Representatives had to choose between Burr and Jefferson. The Democratic-Republicans clearly intended for Jefferson to be president. However, the (New) House of Representatives, dominated by Jefferson's party, would not take office for some months. Federalists still held a majority in the House, and their votes would decide the winner.
Aaron Burr refused to concede the election to Thomas Jefferson. Although the House of Representatives did eventually choose Jefferson as the clear winner (with an absolute majority of the votes) it wasn't until the 36th ballot!

∙ 9y agoIn 1800, the election between Aaron Burr and Thomas Jefferson resulted in a tie. As such, the Twelfth Amendment forced the voting system to change slightly, forcing the House of Representatives to cast a vote in the case of a tie.
