I had the same problem in my 1992 Nissan 240sx.your brake pedal, when at rest is pressing in a switch.when you press down on your brake pedal, the switch is released and your brake lights stay on. most of the time (on nissans) there is a hole in the pedal,and a little rubber bushing fits into it, and the rubber makes contact with the switch
when this rubber gets old and/or falls off, the switch just pokes through the pedal and your taillights stay on.
go to a Nissan dealership (they will usually have this item in stock)it is a very small rubber/plastic button that pops into your pedali just picked mine up for $1.75
it can be very difficult to pop into place
