It depends on what plugin that server is using for rules.
A good idea may be to ask the admins/other players on the server.

No! Mods are short for modifications, which change the gameplay slightly. They aren't illegal, they just support only the version of Minecraft they are compiled for. Jeb is even thinking of adding "Mod Support". Although, If you are playing on multiplayer servers, you should check the rules because some servers ban certain mods/hacks. Some servers even require you to download certain mods and/or texture packs to log into them (Tekkit servers, etc.)

There is this Server called Punchblocks its IP: punchblocks.net Its the best server but you have to follow the rules.
Classic Servers: Classic servers are free for all to play. Creative/Survival/Hardcore: Many of these servers require you to fill in an application in the servers "official" thread on the Minecraft forum. Most of the time, servers are "whitelisted". Which means you cannot access the server unless your application has been approved. You will be automatically kicked by the server if it does not recognise your name. Some servers are not whitelisted and are free for anybody to join on condition that you follow the server rules. Take a look at the Minecraft forums to see which servers require you to apply or which are free for anybody to join.

Unfortunately, yes there are people who run private servers for world of warcraft. Keep in mind that these servers could be several patches behind the live official servers, and the Game-Masters of these servers follow no rules unlike the official servers. The economy of the private servers is nearly non-existent because of the amount of people on them compared to the official servers.
