The iPhone 4 can only support from iOS 4.0 to iOS 7.1.2. There is no way to get any higher iOS Firmware due to the older hardware that is built into the iPhone 4.
I'm sorry I don't understand better, but apple will not honor a waranty on a jailbroken ios device. I don't thing it violates the user agreement. you can always restore you device and no-one will know (unless it's been bricked).
