Latios can be found anywhere usually at the routes west and east of mauville city.
Latios i roaming around randomly in the Kanto region. You can see where he is by checking your map (just like when trying to find the legendary dogs). When you run into him, your screen will do something different than in most other cases. It becomes bright and kind of dissolves. He is level 45 ... I think. And unless you have a move like mean look or something that will prevent them from fleeing, it will run away.

The games are identical except for which legendary bird you get first (Ho-Oh in gold and Lugia in silver) and if you can get Groudon or Kyogre, and Latios or Latias. Both legendary birds are available in both games, but only one of the two other sets are available in each game.
In the Ruby and Sapphire generation, Latios is only in Pokemon Ruby. After beating the Elite 4, you will end up back in your house. Watch the TV to learn of a blue Pokemon being spotted in Hoen. Now, you must meet Latios in the grass. He can appear anywhere in Hoen, except for buildings, cities, and caves. Once you meet him, he will flee. You must track him down with the Pokedex afterwards. The easiest way to track him with the the Pokedex is to go to a city that has an adjacent route to it. (Sunnyshore city is the best choice). Walk between the route and the city until you and Latios are in the same place. Latios will be very common in the route that he's in. Once you encounter him, you can either use the Master Ball (If you haven't used it already; although frankly you should leave it for Latios), or use a Pokemon with high speed, and a debilitating attack (Such as sleep or paralysis). Should Latios run, don't fret; he retains the damage he receives. Once his health is low enough, when you encounter him, you can just chuck poke balls at him until you catch him. Personally, I would catch a Wobbufet in the Safari Zone to use against Latios. It's ability keeps Latios from escaping, and it's a pretty good tank; it should be able to handle most damage that Latios deals out. In Emerald, it's a little different. After beating the Elite 4, you watch the TV again; however, this time, your mother asks you what color the Pokmeon was. If you want Latios, choose blue. If you want Latias, choose red. Other than that, the steps are basically the same. In FireRed and Leafgreen, you must get the National Dex first (You get this after beating the Elite 4, and catching a certain number of Pokemon (I think at least, I can't really remember)), and then trading it from Ruby/Emerald to those games. In Diamond and Pearl, you get Latios by beating the Elite 4, and activating Pal Park. Then, you insert the Ruby/Emerald cartridge onto the bottom of the DS, and in the menu for Diamond and Pearl it should say something like, "Import Pokemon" or something like that. If Latios is in your box, choose him, and 5 other Pokemon (You MUST import 6 Pokemon), and head into the Park. There you will find him, and you just chuck a Park ball at him. The balls have a 100% catch rate, so you won't have to worry about battling him. And that's all there is to it really.
