You can test your Xbox Live Connection on your dashboard under "My Xbox" and if there is an issue with the connection it will tell you what it is.

go to your dashboard. create a profile with a name you like. then click join xbox live. then enter all the information and you have xbox live! *Note: It does cost money.*

If the dashboard has the marketplace then I cant see why not. However, a ban will be on your xbox if you may do so.
