The person who has custody ( if not a biological parent where parentage is already established and adoption is not necessary or would be initiated) would need to initiate a legal adoption proceeding in the family court with jurisdiction where the child lives. As a biological parent, you are able to retain some rights, even with adoption, so you should consult with an attorney familiar with family law so those rights are outlined and incorporated into the adoption agreement, if you so wish.
