As of right now, a jailbreak for 3.1.3 firmware isn't available from blackra1n. However, if you download the 3.1.2 firmware from www.megaupload.com you can jailbreak it:
1. Go to Megaupload
2. Search iPod Touch 3.1.2 firmware
3. Download it
4. Connect your iPod
5. Open iTunes
6. Backup your iPods data by syncing or right-clicking the name of your iPod (left hand corner of iTunes) and clicking backup
7. Press Shift and Click Restore (WHILE HOLDING THE SHIFT BUTTON!!)
8. Go to desktop and Find the Firmware you just downloaded
9. Select it and click open
10. a message should ask if you want to restore to the 3.1.2 firmware, click "yes"
11. Let it Restore
12. It will ask to restore the information through the backup you did in step 6
13. Let it Restore its information
14. Go to blackra1n and click the Windows or Mac logo, depending which operating system you are using.
15. Download blackra1n
16. Open blackra1n
17. Make Sure your iPod is still connected and press make it rain
18. When it is done jailbreaking, your green battery will show up.
19. In the last row of Apps you will see blackra1n, open it
20. Download CYDIA! Rock and Icy will crash your ipod a lot
21. Open cydia to let it finish installation
22. YOU'RE DONE!
23. If you have an MC model you have a tethered jailbreak(can't turn it off because it will be put in DFU mode) You can find out by going to settings>about> and scrool down to model, if the first two letters are MC then it is an MC model. If you do put it in DFU mode (Connect to iTunes Mode) repeat step 17
24. If the first two letters are MB then you have an untethered jailbreak(you can turn it off freely and willingly without crashing)
