You would have to establish proof that the foundation was damaged by a covered peril on your home insurance policy. Typical covered perils on a homeowners insurance policy are sudden or catastrophic loss or damage from Fire, Wind Hail, falling objects etc.

Foundation damage resulting from ground movement is typically not covered under a home insurance policy as this is considered normal and expected wear and tear over the life of the home except in cases of sudden earth quake where quake endorsement is in place.

Poor workmanship or poor design are also not covered under a home insurance policy. These issues are what is covered under the builders warranty or home warranty offered at the point of sale when you purchase a home.
