You don't need the battery to operate the latch. It is mechanical. Simply turn the key to the seat position and push it in. The push button is attached to a cable linkage which in turn opens the lock mechanism.

You need a battery. The battery prevents surges when you rev your moped. It should be located under the seat. If there is one you need a new one.
