It is legal because of the federal law called Communications Decency Act or CDA, 47 U.S.C. § 230. However, the United States Court of Appeals for the Ninth Circuit stated that the Communications Decency Act does not immunize misrepresentations made by a publisher about its publishing conduct. New laws and court cases may soon change the way these sites operate.
