Many states require that you be a licensed contractor WITH a business license. Then you need to fill out the paperwork and have it recorded at the county recorders office. Understand that there are serious penalties for anyone who falsly files a property lein.

you file a mechanics lien or materialmans lien against the property in the county clerks office...that form can be found on line by finding a title company within your state, most whom have forms available for download at no charge...to find a title company search Google and enter...(whatever state) and land title association...that should give you enough choices in your state that you can find the form on line...it is a legal form that must be notarized before filing, and be aware that the statute of limitations for this lien in most states is between 6 months and 1 year...after filing the lien, you have only a certain time frame in which to bring an action in municipal or supreme court to force payment of the debt...for that you should speak with a lawyer

Once a party has been successful in a civil lawsuit they can request a judgment lien from the court. The lien must be recorded in the land records. Once recorded it becomes an encumbrance on the property. The property cannot be sold or mortgaged until the lien is paid.

What is a real estate vendors lien in Texas?

A real estate vendor's lien in the state of Texas is a type of lien put on a building project. If the contractor doing the work on a person's home defaults to his/her creditors, a lien can be put on projects that he has already completed or projects that are still in process. This means that the owner of the property where the project was done, has to pay the lien before they can sell the property. Then, the property owner has to sue to get the contractor to pay them back.

Can a contractor lien the property and my vehicle?

Yes and no. The contractor can file a lien against your house for non-payment. Even if you honestly don't owe the contractor any money, he may still lien your house; he will eventually have to prove the lien's validity in court or it is automatically released. No lien can be filed against your car. However, if the contractor gets a judgment against you, that judgment may be executed against your car and home to secure payment.

How do you collect monies owed to a business by a contractor for work you performed on a property?

Place a lien on the property, house, etc. You will have to go to the courthouse where the property is and file a lien against the person(s) who owes the money. If it's a house, building, etc. the property cannot be sold until the lien is solved. It varies by state so check with your local courthouse.

How do you collect a lien on property not worth as much as the lien?

In order to collect on the lien, you will need to see a real estate attorney and have the lien foreclosed. In some states, deficiency judgments are allowed (meaning that if the property is worth less than the lien, then any unsatisfied portion of the foreclosure judgment could be executed on other property of the defendants). See the phone book for real estate attorneys who give "free consultations."

What is the purpose of a lien being placed against real property?

A lien prevents the property from being sold without paying off the creditor. After a certain period of time, it is possible to foreclose on the property, sell it, and collect the amount of the lien, the balance going to the property owner or other creditors.

What is a construction pre-lien?

What a "Pre-Lien" is depends upon the state. It can be a Preliminary Lien Notice that notifies the owner(s), lender(s) and primary contractor that you have been contracted to provide material, labor or services for the improvement of real property and will ultimately look to local lien laws to collect your money, should it be required. Some states only require a Warning Notice be delivered prior to the lien being recorded. These notices warn that you have not been paid for work and will be liening the property within a specific time period.

Can a private contractor place a lien on someones property even if no written contract exists?

Yes. A licensed contractor could claim a lien under the legal doctrine of quantum meruit. However, the lien will expire (in 8 mos. in WA) if not foreclosed. Your best option, if you are not selling or refinancing, is to do nothing.
