No. Jailbreaking an iPod Touch voids your warranty. If you send them the device anyway Apple will be able to detect that you have jailbroken your device and refuse to repair it. if your ipod touch has lost it touch, that probably means the screen is broken. if it has cracks, there is another sign. my friends lost her touch and had to order a new screen from apple, or go to the store were you bought it.
well, if it dosn't touch, then it isn't an ipod touch! i would either take it to an apple retail store close to you (you can find where they are on the internet) and ask them to either fix it or replace it. They definitely will replace it if when you go it is within 90 days of purchase or if you have extended your apple care plan for extra money. If it is not within your apple care expiry then I would still go to an apple store and see what they say
