First, this is a very complicated issue. YOU NEED TO GET AN ATTORNEY to be able to fully answer thid question. The penalties would usually be spelled out in an employment contract. Industrial espionage could also constitute theft in some rare cases. Generally though, this is a civil matter and if caught, you will be held financially responsible for the any losses you have caused. In addition, the company that you work for that is sanctioning the espionage could be punished financially. If there is nothing in an employment contract that says that you can not work for a competitor at the same time and there is no non-compete clause for the length of time that you can not compete when you move from one company to another it would be difficult to enforce any issues regarding espionage.
