Roman Catholic AnswerFirst of all, adultery is not a basis for a decree of nullity. A degree of nullity is a ruling on whether a marriage was a valid sacrament or not. the only things that go into that are what happened up to the marriage and the ceremony itself. If you wish to apply for an annulment, you should start by talking with your pastor.

Does the annulment of previous marriage make the subsequent marriage valid?

No. Once someone has a marriage annulled in civil court the parties are free from each other and any subsequent marriage is valid as long as the subsequent marriage took place afterthe first marriage was annulled.A marriage that was entered while one of the parties was still married (which would be the case prior to an annulment) is null and void. A subsequent annulment of that first marriage would not "cure" the second one. The parties must arrange to get married legally.

What is the caholic church's position on divorce and remarriage?

Currently, divorce is not okay with the church. Annulment is however. In order for a marriage to be annulled, one must prove there was one of several causes- abuse, adultery refusal to copulate, etc. If one goes through the annulment process, and it is approved, they may then remarry. A divorced person may try to have their marriage annulled later; but unless it is, they cannot remarry in the church.

Can you get an annulment in Alabama?

You can get an annulment in Alabama as long as essential elements are met. One of these elements must be met to get an annulment: 1)physical incapacitation at time of marriage; 2) voluntary abandonment for one years; 3) imprisonment for two years; 4) drug or alcohol addiction; 5) wife pregnant at time of marriage without husband knowing about it--to name a few. If one of the elements is not met, then there will be no annulment. In an annulment, the court declares that there was never a marriage. If you want to go this route, you should definitely speak to an attorney.

Why do early marriage can result to annulment?

A Catholic annulment is only available to someone who can prove that no valid marriage ever existed the first time around. Early marriage would have no bearing on the matter. Added: A legal annulment can occur when one party can prove that the marriage was not entered freely and voluntarily. For example, if one party was under the influence or married under duress. Sometimes a very young person who is married can show that he/she entered the marriage at the insistence of another person and felt that he/she did not have a choice, and will therefore assert that the marriage was entered under duress and seek an annulment.

Is it a mortal sin to get remarried without an annulment?

A Catholic is not free to marry more than one person. The annulment process is simply that: a process which must be investigated to its final verdict on whether or not a previous marriage existed or not. During the time this is being investigated, the Catholic is still to be considered 'married' and thus not eligible to date others, marry someone else, or have marital relations. If the marriage is found to be in tact, it can not be broken by any man or institution here in this world. Only God can dissolve the bond, at death. As it is written: "For what God has joined, no man may separate." (Mark 10:9) To violate the marriage covenant is a very serious (mortal) sin. The Church can not be more clear on this: any Catholic that violates this sacred bond of marriage is indeed committing adultery and anyone associating themselves with a married Catholic is also committing adultery. The Church also goes on to say that marriage is not just a supernatural grace that comes from receiving the sacrament but a natural institution as well. That is, before Jesus' time here in this world, marriage was (and still is) an institution between a man and a woman governed by natural law. This is why the seventh commandment states, "You shall not commit adultery" because it isn't just something that Christians believe. Instead, when it comes down to it, all rational thinking humans deep down really understand marriage as important and adultery as wrong.

When is it too late to get a marriage annulled?

AnswerAnnulments can be a complicated and confusing process and unfortunately, thee are no set standards to help you determine whether or not it will be granted. There is generally no set time limit after which you cannot get a marriage annulled, but the grounds for annulment become harder to prove over time. Additionally, annulments are best suited for short marriages (usually weeks or months) because those unions generally do not involve joint assets to divide or children.

It is all right to the Catholic Church regarding legalization of divorce?

One can get a divorce through legal channels but it is not recognized by the Church as the Church does not recognize divorce. The person will need to seek an annulment of the marriage through the Catholic Church. If the person were to remarry without an annulment the Church would consider the person to be living in adultery meaning the person had, in a sense, excommunicated himself from the Church and would not be eligible to receive the sacraments.

Can a marriage be annulled for religious reasons?

That depends entirely on what you are asking, how you are defining your terms. An annulment in the Catholic Church is granted for a defect in the original marriage - or before. Such an annulment is just a decree that no valid marriage actually happened. But such an annulment has no weight in most civil governments, and the reasons may or may not be religious. However, if you are asking if a marriage can be annulled, for instance, because one spouse becomes a Christian, then, yes, this is called the Pauline privilege where the marriage is dissolved not annulled. The Petrine privilege is where a valid but non-sacramental marriage is dissolved not annulled in the favor of the faith if one person becomes Catholic and wishes to be baptized.
