Best Answer

An owner interested in suing the association is required to document the basis for the suit and provide evidence of it -- usually that the owner has requested the board to verify.

Take your evidence -- with the board's response -- to a local, common interest community-savvy attorney and discuss the situation to verify that you have a case and that the attorney is willing to pursue it with you.

How do you report Illinois homeowners association fraud?

You need physical proof of fraud, which you can collect from the business records of the association if you are an owner. Then, take your evidence to an attorney who specializes in common interest communities -- your local Community Association Institute can offer you names of local professionals -- and be willing to pay for a consultation to determine whether or not you have a legal case against the association. If you are a vendor, you can start with the attorney general in your county, with evidence of the fraud you allege. Those professionals can direct you to the property adjudicating authority.

This subdivision has been a non-gated community and no associations but now several homeowners in the sub want to start one Do they have a right to make those of us who don't agree pay for this?

Composing an association that has not been specifically designed and sold as an association is difficult. First, there is no basis upon which to compose an association, such as shared real estate assets, which is usually the case with an intended association. If you do not agree to the association, you should not be forced to pay for it -- unless, the association develops assets that owners own in common, such as a community pool or park. In which case, if you expect to be able to take advantage of this community asset, you should be willing to pay for it.

What can I do my neighbors snow plowing contactor pushed the snow from their parking lot against my fence and damaged it and the police say it is a civil matter?

If i were you i would go and ask your neighbors if they could help you move the snow and build a new fence. There is no criminal charge, so the police will not get involved. What you can do is bring a civil law suit against the snow plow contractor. They should have insurance to take care of these types of issues. I'd start with a letter to the contractor and depending on how they respond, I'd contact a lawyer in your area. You might also contact your homeowners insurance company. They may help pay for the damage and then go after the contractor.
