Simply write a letter to whoever has your records, that reads roughly like this: As is my right under the Health Insurance Portability and and Accountability Act of 1996 (HIPAA), Administrative Simplification, Privacy Rule, Required Disclosures, I, full name goes here, on this date, date goes here, formally request a copy of my entire and complete Designated Record Set (DSR), as defined under Privacy Rule, Definitions, to be delivery address and means of delivery here, or say you'll pick it up at their location. Please contact me at Phone or contact address goes here in order to inform me when I can expect delivery of the aforesaid DRS. Time is of the Essence! Your name printed, signature as well, date it. expect a reasonable charge. Anything over $50US that doesn't include images (xrays and the like), gets this followup letter before you pay (or this one you can do in a call): Regarding my request for copies of my full designated record set, dated fill in request date here, I shall pay the requested amount under protest, and file a formal complaint charging retributive costs placed in order to discourage me from revewing my medical records, with the Dept. of Health and Human Services, Office of Civil Rights (DHHS, OCR). It's better if you can address the situation more casually, but if you can't -- here's the ammo. You can likely get the records by filling out a request form for them. Also, you can often address overcharging you over the phone, as the covered entitity is required to make sure your reasonable request for your medical records is honored. The cost is meant to offset copying fees, and not be a source of income or, worse, a punishment for asking for your records. Note also there should be no charge for simply seeing your records.
