Credit card companies are not the ones that bring lawsuits against the debtor. As a general rule, the account is termed a "charge off" and the account is sold to a third party collector. These agencies work with collection attorneys who decide whether or not to sue. That decision is made on how collectible the account might be. They will sometimes wait a year or more to begin legal action. After a suit is filed, the average time it takes to get into court is 15 months. In some states, depending on the system it can take much longer. There are many contributing factors that can delay the action for an indefinite period of time. Do not forget that the exemptions that apply in bankruptcy also apply in lawsuits. And there are Federal exemptions that can be used outside of bankruptcy proceedings if they can aid the debtor.

In general if you are finding difficulty in paying off loans, you should seek help immediately from an advice centre. People can mediate and help you and if appropriate have the addition of further interest being applied to your account frozen. This will have consequences for your future credit scores but will stop the debt spiralling out of control. The mediators may also be able to agree a repayment plan to pay off your debts that is within your means to service.

They can do whatever they want if you are behind, but it would be weird for them to pursue collections if you are making REGULAR payments. Call the credit card company and make arrangements.

How can one apply for a credit card when already has a mortgage in the UK?

As long as one is not behind on their mortgage payments, one should not effect the other. If one hasn't been making payments they will likely not be accepted for a credit card.

What happens if you did not pay a credit card debt in UK?

The card company can (and usually do) take you to court to recover their money. If you have a credit card, you have a contract with the card company to repay any outstanding balance. If you default on payments, you will have ample opportunity to rectify your failings. If you simply ignore reminders etc - the card company can swiftly get you into court to answer for your failure to keep to your part of the contract. A judgement against you will result in money taken directly from your wages (or state benefits) and you will be placed on the bad debtors list - making it virtually impossible to get a loan, mortgage or credit card in the future. If you're having difficulties making the monthly payments - TALK to the card company ! They would usually prefer to come to a sensible arrangement, that go through the legal route !

If you are enrolled with a debt consolidation program can the credit card companies sue you and take your property?

First off, the credit card company doesn't want your stuff. They won't come and take your TV or whatever you bought. Usually, if you are having a debt consolidation company divide up your payments - the credit card company won't bother you. BUT, sometimes the consolidation companies don't start making the payments when you give them the money. Sometimes, they keep your first and/or second payments as part of their fee. IF they didn't pay, the credit card people can sue you.

Does the credit card company can sue you because of non payment of your monthly dues while you are staying in the other country?

A credit card company will add non payment onto the outstanding balance and that in turn wil incur the agreed interest charges of your credit card company. Also, if you continue to miss payments even though you are staying abroad, this will eventually affect your credit rating, making it very difficult to get future credit.

Can a credit card company put a lien on a car your making payments on?

If you fail to make payments on your credit card, the company could sue you, take a judgment against you, and possiblyseize your car and sell it at auction. However, the credit card company would have to pay off the car loan in order to clear the title. That would not be worthwhile for them to do unless the car was worth significantly more that the unpaid car loan balance. It is also possible that the credit card company could not seize and sell your var because most states provide certain exemptions from execution on judgments. These exemptions vary widely from state to state.
