Laws and legislation are not universal. Many countries have no regulations on texting whilst driving.

In those that do it is unlikely you will receive a custodial sentence unless there were other more serious consequences of doing so, or you were guilty of multiple offences.

Added: I don't believe that (in the US) there is yet any state that has enacted a state-wide anti-texting law. In some states, local municipalities have enacted such ordnances and they amount to a ticket offense and points on your drivers record.
