It all depends on the state. I work for a storage company and our policy is 41 days late, before we cut the lock. Then roughly 2.5 months before auction. We are in IL for reference.

Can a commercial landlord keep tenants office contents for delinquent rent?

Generally, no. The landlord would have to first acquire a legal interest in the office contents, either by a signed security agreement with the tenant or by filing a lien and following up with a court order of liquidation. Of course, a tenant can certainly offer to give the landlord a commercial security interest in the office contents, or the tenant's inventory or equipment, if the tenant chooses.

How long does a tenant have to remove property after breaking lease in NJ?

In most states, when a tenant has been lawfully evicted, the landlord has the right to remove the personal belongings of the former tenant from the rental property. Each state, however, has laws regarding what the landlord must do with that property after removing it. Some states require the landlord to keep belongings in storage for 30 days prior to disposing it - in this case the landlord has the right to collect the storage fees from the tenant before releasing the belongings - while other states, such as Florida, permit the landlord to dispose of the belongings as the landlord sees fit. In South Carolina, the landlord has to remove all property and place it on the curbside, where the tenant has 48 hours to retrieve them or they will be disposed of.

When can a manager of an apartment complex change the locks?

In Canada if there has been several break-ins in the complex then the landlord has the right to change ALL locks, but the tenants must be notified and given a new key. The only other reason would be if the tenant has not paid their rent, then the landlord can change the lock on that particular apartment with the contents still in it until the tenant pays the rent. In the US a landlord cannot use self-help to hold the renter's personal property for rent due, unless it was so stated in the rental agreement. Before a landlord can seize property and lock a delinquent tenant out of the residence they must use due process of law, receive a Writ of Possession and serve the delinquent tenant with the writ. If the tenant does not recover his or her belongings within the specified time limit, the landlord can consider them abandoned and dispose of them in whatever manner chosen. If the landlord wishes to remove the property from the residence before the set time expires he must secure those items in a storage area.

When is bank responsible for paying back rent to mobile home park on a repossessed home?

Typically, they are not responsible for back rent. The mortgage contract the tenant has with with the lender is between the tenant and them. The rental contract you have with the tenant is between the tenant and you, and the lender does not enter into this picture. These are two separate transactions.Insofar as any unpaid back lot rent owed by the former tenants before the foreclosure - the lender is not responsible for these and you would have to file a personal lien against the former tenants. However, you MAY have some leverage to hold the mobile home for the payment of "storage fees" incurred since the date the lender foreclosed before you allow the home to leave the park.

Can a foreclosure attorney collect rent from a tenant before the sale?

Is a tenant responsible for carpet that is old when they move in?

That depends on if damage was present when the tenant moved in, the length the tenant resided there, the type and level of damage caused. If the tenant lived there 15 years and the carpet had been there 10 years before the tenant moved in, that would be reasonable wear and tear as the carpet is 25 years old.
