Actually, there are not " permissive " courts. This is a fallacy put out by people who don't like the judicial system. The courts are governed by laws that determine what the sentence will be. Voters make the laws. For instance here in California a law was passed that moved some crimes from felony to misdemeanors, so crime has gotten worse because people who would have gone to prison for stealing cars now only get a slap on the wrist. The court didn't make this happen the voter did. We also hear about "unelected " judges. This is a GOOD thing because they do not owe their appointment to any person, funding from a business, or political party and it allows them to make objective decisions.
