If you have a lien on your vehicle, you can sell it for any amount. The vehicle is still subject to the lien which means that the purchaser can lose the vehicle if the lien holder collects on it.

If you default on a leased vehicle can the bank place a lien on your home?

It is possible. While it is more difficult for a vehicle lien holder to extend a lien to other, unsecured property, it is possible with a legal judgment. It is much simpler for this to occur if the lien holder and mortgage holder ar the same. In situations such as this, it is a simple matter of cross colateralization.

If you filed bankruptcy and one of the creditors had a lien on a car do you get the title back after the bankruptcy is final?

It really depends on the type of bankruptcy petition you file. If you file for Chapter 7 bankruptcy the creditor who put the lien on your car may be able to take your vehicle. If you file for Chapter 13 bankruptcy you'll have the opportunity to make payment arrangements with your creditor and in that case you should get the title back after all of your payments are made and your amended. contract with the creditor has been fulfilled.

How can you find out who has the lien on a car that hasn't been paid when the loan is in Michigan and the car is in Arizona?

Conduct a DMV report. Lien holder information is typically part of the information returned. You will have to get the report from the state where the vehicle is plated. And, you can contact pretty much any private investigation service to run a report for you from any state, for any state, while you wait. You will need the Vehicle Identification Number (VIN).

What is a Lien Fee?

The lien fee is the amount charged to record the lien. This amount will vary per state. To learn how much it is to record a lien call the Clerk of Court or Registrar's Office. If you use a lien service to file the lien then their fees would be the lien fee.

Can you file bankruptcy on a car title loan?

Sure, then the bank will come back and get the vehicle and send it to the auto auction to get as much of their money as they can. Bankruptcy only applies to unsecured loans. The vehicle loan is secured by the title of the vehicle. If you don't pay, see how long it takes the bank to inform you that the vehicle is now theirs.

You want to buy a used car from a dealer but car has lien on it what should you do?

I would be very leery to purchase anything from anybody while there's still a lien attached. As you probably know, this entitles the lien holder their right to however much was loaned against the vehicle, which must be cleared at the time of title transfer. The dealer should have taken care of this when they purchased the car from the prior owner. Assuming the vehicle is worth pursuing, try making an arraignment with the dealer where they will allow you to accompany them to the lien holder's business, at which point the bill can be settled. Under no circumstances should you pay for the car without them first taking care of the lien.

How much does it cost to place a lien on someone's property when they owe you money?

The cost of obtaining a lien depends largely on the type of propery, the type of debt, whether you obtained a security agreement and whether the law grants you any special status to file a lien without going to court like a mechanic's lien. If you are a secured lender, you already have a lien. If you have special status like a contractor, you may be able to record a lien for a small fee or assert a lien by keeping property already in your possession. If you are unsecured, you may need to file a lawsuit and get a judgment lien after you win the case. The actual cost could range from a few dollars to hundreds or thousands of dollars if you have to sue in court first.
