that depends on the crime. murder has no statute of limitations. 7 years on most property crimes. however states vary.
Unless "you" are the government, you don't. Private citizens cannot "prosecute" anyone. You can make a complaint to the police about it in the hopes that the government will choose to prosecute, but that's about it.

They would prosecute to the maximum extent of the law.

Well, its illegal. Most District Attorneys offices wont prosecute it though. But if you do it enough, they can and will prosecute you. Its called Theft by Check.
