Possible defenses to an OSHA citation include:not a recognized hazarduncontrollable employee misconductmisunderstanding of the situation by the OSHA inspector and there actually was no violation
OSHA has no requirement for spore testing.
And OSHA fine is an amount of money that must be paid by an employer because OSHA determined that the employer violated an OSHA regulation. Certain rules and regulation in the workplace and operations of sites such as construction sites were created by OSHA to improve safety of the workers. If they have found companies operating without being compliant to their rules, they give them penalties to pay for - something that is better than having to pay for someone's life.

If the construction job is not a Federal or State-funded project, then it is required to follow OSHA guidelines. And, you may call the OSHA hotline to report any Life-Threatening workplace issues-- 1-800-321-OSHA. Even if it is a Federal or State contract, you may find help at OSHA. These contracts have a legal exclusion, but OSHA can pressure them to change certain practices.
