The agreement the Israelites made with God was:

These are the words which thou shalt speak unto the children of Israel. And all the people answered together, and said, ALL THAT THE LORD HATH SPOKEN WE WILL DO." (Ex.19:5-8)

The Lord then had them prepare themselves for two days... wash their clothes and take a bath. And on the third day, His voice spoke the Ten Commandments into their ears - Exodus 20.

The Old Covenant, then, is the promise of the people to keep the Commandments of God, which His voice, that they promised to obey, spoke on the third day.

"...I spake not unto your fathers, nor commanded them in the day that I brought them out of the land of Egypt, concerning burnt offerings or sacrifices: but this thing commanded I them, saying, OBEY MY VOICE, and I will be your God, and ye shall be My people: and walk ye in all the ways that I have commanded you, that it may be well with you. But they hearkened not, nor inclined their ear, but walked in the counsels and in the imagination of their evil heart, and went backward, and not forward." (Jer.7:22-24)
