If you want to purchase an exhaust system you could go to a place like autopartswearhouse.com. Or you could look up exhaust systems of craigslist to see if there is anyone near you selling an exhaust system.
I doubt a holed exhaust will pass. Apart from an increase in engine noise, as the exhaust is not working properly, exhaust fumes could seep into the interior of the vehicle - affecting badly anyone inside the vehicle.
There is no way for anyone to tell without looking at it or without you giving some sort of information about the exhaust system. You'll have to tell what it's doing wrong.
Sounds like a partially blocked exhaust; either catylitic converter or muffler. A vacuum test can diagnose this in general, and if a blockage is indicated, trial and error is the next step.
It is mounted in the exhaust system. Start at the exhaust manifold and work backward toward the catalytic converter. It is more than likely mounted in the exhaust manifold right at the engine. It may also be mounted where the two exhaust pipes come together.

Look on the exhaust system before and after the catalytic converter.
