If the judge decides that your home is better for your children than your wife's then you can take your kids if you are divorcing their mother. However, if you just take the kids without first getting a court order, you could be in serious legal trouble.
Your rights are equal unless/until court says otherwise.
If it is your weekend and the mother will not let you pick up your kids, you should take it back to the court. She is in defiance of a court order. Take it up with the judge. Make it her problem, not yours. When she is in the pokey, she might change her mind.
is it legal for your ex to take your kids without a court oder
As long as no court actions have been taken against the mother for abandoning the children she can still show up again and demand to see her children. Only court action take take away her parental rights. If the father (or guardian) went to court after the abandonment to get custody he can refuse to allow the mother to see the kids, but the mother can take him to court to gain access to the children. It's very important that fathers file for custody. I've seen cases where the mother came back years later, as to take the kids somewhere, and the where is the court house to file for custody based on possession. By the time there's a full hearing, the judge is unwilling to give the children back to the father. see link
Take it to court. What shes doing is taking custody of the children, if its not a legal custody, court is a good way to figure it out.
The court must have followed the due process and the evidence to take the kids away from you. All is not lost, you can always make an appeal to a higher court.
If the drug test is not court ordered, you do not have to submit to it. However, CPS may take your child until a court order is in place.
Through court actions, but not on her own.
