Anything is possible. If both parents agree, then custody may be signed over civilly without involving the court in many states. If the parents object, it would have to go before a judge. The judge would listen to reasons why, what all the parties think, and determine what they feel is in the child's best interest. If the parents will not willingly give up custody and the child is not in a dire situation, the chances will be much lower.
