An illegal resident can not legally get married in the US. In order to obtain an Marriage License, you must be able to prove that you are either a US citizen or here legally.
Firstly, if the person is married in an another country and has come to a particular country illegally it is surely invalid to marry the person. Another thing, if the person is a citizen of that particular country in which he has married it is his right to first take a citizen of that country in which he is going to marry and then he can marry a person another to his own country.

to my knowledge, if you as an American citizen are LEGALLY married to an illegal, all that you have to do is go to your local immigration office and apply for his residency. it is better if you are married in the u.s. before applying. if you guys married in the u.s. so much the better. make sure that he does not have a criminal record or that is it. if you married outside the u.s. what i would do is to marry again in the u.s. so that immigration will "recognize" said marriage, but yes, as a u.s. citizen, applying for your spouse is one of your privileges and rights for being a u.s. citizen...good luck
Once you are officially married to an American citizen, you can not be deported from the country, unless you engage in a criminal offense.
I married an illegal alien in May of 2006 and he was required to return to his birth country to attend and interview. You may do all the paper work here but from what i understand from my experience is they do have to return to their birth country and receive permission to return.
A visa has to be applied for before returning to the country.
