It is called a "hung" jury. Usually the judge will instruct them to go back and keep trying and to re-consider their positions, but if it is an issue that cannot be resolved, he will dismiss the jury and the case will be re-scheduled for trial in front of a new jury at a later date.

If a jury in a criminal trial cannot come to a unanimous decision, after adequate amount of time and effort, the judge will declare a mistrial. This doesn't mean that the person gets off without going to jail on the charges. It simply means that the prosecutor will try the case again. The process will start over with a new trial date being set and the trial proceeding again. At the option of the prosecutor, they could decide that they will not proceed with the case, but this would mean that they changed their mind about it being worth it to prosecute.
