If a person dies because of accidental drowning does it matter what he was doing prior to entering the water?

One possibility is that they may have eaten a meal, especially a large meal. Since our bodies require a very large expenditure of energy, participating in activities that also require a large amount of energy like swimming overloads our bodies resources. It is possible to get muscle cramps and/or have more difficulty swimming. If you're jogging after you eat, you can always stop if you start to feel tired, but if you are swimming, you may not be able to get close to the shore or more shallow water. The danger is the possibility of drowning.
I assume an insurance company is trying to deny a claim. If the deceased was drinking heavily, taking illegal drugs or running from the police, they may try to say it was the result of an illegal activity. They may also have a clause exclucing certain dangerous activities - did he skydive or basejump into the water?
