Yes, you should use your check stubs and figure your income and taxes, if you do not have them all do the best you can at guessing. File your taxes along with a letter to the IRS informing them you did not get the W2. I had to do this one year and the company was to be fined and I was to receive the W2 later, neither happened.

If you do not have a W2 you can call the IRS after May 1st of the year in which you need to file and order a transcript of your W2 as the IRS will have received this informaiton from your employer. Yes if you are required to have a W2 you employer has to submit this to the IRS otherwise they could possibly face a fine. 1-800-829-1040 7:00am to 10pm M-F
