The estate has to pay off all of the debts if possible, using the IRAs if they can. If the estate doesn't have the assets to do so, they distribute as best they can. If the court signs off on the distribution, the debts are ended.

The borrower, i.e., the person who signed the note, is responsible for payment. If the borrower has died their estate is responsible. If there is no estate the creditor is out of luck. If there was a co-signer then they will be held responsible for paying the debt.

My father died owing 20000 medical debt from my mother also dead. He left the house to my sister and I who had it put in our name via quit claim. We are selling it- do we have to pay mom's debt.?

If the house was not properly dealt with during probate as part of your father's estate, you may be found guilty of fraud or deceit. Make sure you know the details of the transfer of the house title. The medical bills may need to be paid as part of the obligations of the estate.

Her son would "inherit" the debt only if he co-signed with her as a borrower. Her estate would pay the debts and the creditors would take the loss if the procedes from the estate were insufficient.

Your father inlaw has died and left money in his will to other people but there is only engough left to burry him what shall you do?

An estate for your father in law should be opened. After all debts against the estate are settled, then monies can be distributed per the will. I believe burial would be a debt against his estate. Consult an estate attorney. It's not feasible to give away his money while he doesn't even have any to give after he is buried. Common sense should prevail on this one...but seek legal advice from the estate attorney.
