If you infringe on someone else's copyright, its owner has every right to take you to court in all countries that have accepted the Berne Convention on copyright - which means, in most countries of the civilized world. Even if you are a first-time offender. In most cases however, the owner's lawyer will first send you a 'cease and desist' letter, sometimes together with a demand of damages if he thinks you have been making good money though the infringement. This way he hopes to avoid the often high cost of ligitation in court. But if he takes you to court right away (for instance if he is convinced that you are already knowingly infringing on his copyright) he has every right to do so.
