If this was a judgment award you will need to prove that it is in the best interest of the child to live with you are and whatever issues were involved have been resolved.

Depending on the age of the child he can say for himself which parent he wants to live with as long as there are no judgments against you.

If this was a custody agreement between you and the father, it is something the two of you should resolve amicably. Talk to the father and explain why it is in the boys best interest to live with you. Judges are more and more trying to get parents to work thinks out for the best interest of the child.
