If it is in both of your names, and she is bankrupt...there are many variables. Do you plan on keeping the home? Do you live in it? Does she? Do you both?

You will need to consult with an attorney in your area to find out your rights and responsibilities here. That is very important.

The mortgage is in your wifes name can the IRS take it?

What's more important is who the real estate is deeded to. If you are neither on the mortgage nor the deed, then the IRS would have a tough time taking it. An exception to this is if you live in a community property state, in which case you would automatically own half of the house regardless. Also, I am assuming that your wife is not liable for the taxes.

Just because your partner has no marital binding to you does not exclude you to your responsibilities to your child. You are still liable for child support. Sorry, it is probably not what you wanted to hear but the child is still half yours.

Yes. If you are a joint fee owner and you didn't sign the mortgage then your half interest is free of the mortgage.

If you are going through a divorce can one spouse sign over their half of the mortgage to the other party without having to refinance?

It is my understanding that if both are on the mortgage, you must refinance so that you are both not held liable for the balance. If still on the note the other person would not be able to qualify for another house, car, etc. without that being considered as part of their debt.

Can real estate property be split and half of it sold when house is still mortgaged?

It all depends on the description of the property covered by the mortgage. If the entire property was described in the mortgage the bank owns an interest in it. A half cannot be sold unless the bank agrees to partially release that portion from the mortgage. It all depends on the description of the property covered by the mortgage.
