Most leases have provisions that automatically terminates the lease in favor of the deceased tenant. However if the unit is damaged beyond normal wear and tear then the landlord may still keep the deposit.

Every state has its own rules concerning the handling of a deceased tenant's home. Normally the landlord must allow some time for the estate handler (executor or executrix) to confiscate and remove the deceased's belongings.
