No, it makes you both single people in breach of the law! You cannot legally file jointly if you are not married. You swear that how you are filing is an allowed method....and not being truthful about these types of things...carrying your SS# and all...well they are known to be discovered fairly easily. Whatever you file or say to the IRS will not make you married...that is a different legal process.

Why file single on your federal taxes when you are married and does it effect your spouse if one of you dies?

If you are married, you cannot (and should not) file single. Your choices are Married Filing Jointly or Married Filing Separately. The only time I usually see a Married Filing Separate return is either if the spouses, as a rule, just keep all of their finances separate, or if one of them owes taxes. Remember if you owe taxes the IRS will keep your refunds to apply to that balance due, so if only one of you owes taxes you can file Married Filing Separately and the one of you that does not owe taxes can still get their refunds. Also if you are going to owe on a tax return and file that return as Married Filing Separate, and then later die, your widow will not be responsible for the taxes.

I got married in October of 2014 but my wife is not a citizen Will I still be able to file my taxes as married?

As long as you were married on December 31, 2014, you will file your taxes as a married person. Being married in October of 2014 qualifies you to file taxes as married.

How do married people file taxes if they do not live together?

Whether they live together or not is unimportant. As long as they are married they have the right to file jointly BUT DO NOT HAVE TO. It is an option that can be chosen or changed every year to each filing separate returns.

How much of the year do you have to be single to file as single on taxes?

If you are considered single for tax purpose when the year ends, you can file as single. Even if you get your final divorce decree at 11:59 pm on December 31, you can file as single. And, even if you are married, you don't HAVE to file jointly...you may use the "married filing separately status" (which is different than the "single" status)...and change it every year, at your election.
