I don't think so. They are not required to keep lending the card holder money if the card holder stops paying it back.

If a collection agency freezes your bank account and on the next day you file for bankruptcy can they still freeze your money?

A collection agency, or any party, can only freeze your bank account IF they have sued your first and won a judgment against you. If you file for bankruptcy, it will not immediately release the levy on the account. The court that rendered the judgment must be notified of the bankruptcy filing, as well as the judgment creditor. The account could remain frozen until the outcome of your bankruptcy. If your bankruptcy, and the judgment debt is discharged, then the bank account must be released. It is possible to release a levy before discharge, but it will usually require the bankruptcy attorney to do it.

Can a credit card company freeze your bank account?

A credit card company cannot freeze your bank account. However, it can sue you in court for any overdue balance. If the credit card company is successful, the court will issue a judgment lien that the creditor can use to freeze your bank account and seize any money you have on deposit. In fact, the judgment lien can be used to seize any assets you own to satisfy the lien.

Can a credit card company take you to court and garnish your check if you do not make arrangements to settle your account?

A credit card company can refuse your offer of settlement and proceed with legal action. They must win their court case and have a judgment declared against you before your wages or bank account can be garnished.

Do collection agencies have the right to freeze my vanguard investment account?

In the event a judgment is granted, all financial assetts are fair game for levy or garnishment. The only protected financial transaction would be an IRA or pension fund. If the account is frozen, a second order has been granted by the court, and attachment of the funds in that account are currently underway. Freezing the account prevents you from pulling it out before the attachment order can be prepared.

When a judgment has been made against a person will this affect checking or savings accounts in Michigan?

A writ of judgment can be used to levy a checking or savings account that belongs to the debtor. Joint accounts can be partially protected but the other account holder must file the proper documents with the court where the judgment was granted. The bank has no obligation to notify the account holder(s) that the account has been levied. The account holder(s) should remove funds and close the account if at all possible. This can only be done BEFORE the judgment has been executed.

Can a collection agency freeze your bank account in New Mexico?

Before an individual's bank account can be levied he or she must be sued by the creditor. If the creditor wins the suit (they almost always will) a judgment will be awarded and the judgment can then be used as a bank account levy. Bank accounts are 'frozen' by the court when the account is jointly held and only one account holder is named as the judgment debtor. This action allows the non debtor to provide proof as to the amount of funds belonging to them.

Are there garnish bank accounts in South Carolina?

What does 'attach your bank account' mean?

'Attach' is another term used for the action taken when a bank account is levied by a judgment creditor. In the majority of instances a judgment creditor can execute the writ against a bank account held by the judgment debtor (or jointly with another party) and withdraw the amount owed until the judgment is paid. State law determines the judgment terms, therefore the levy process will differ somewhat from state-to-state. Generally a bank levy has a specified time in which funds can be seized, then the judgment must be refiled with the clerk of the issuing court before more monies can be taken from the account. A very few US states will not allow the levy of a bank account by a judgment creditor when it is held by a married couple as Tenancy By The Entirety.

Must a debt collector give advance notice before freezing your checking account?

No. But they must attempt to recover the money from you before doing this. They will have to contact you multiple times.

Can you stop a creditor from freezing funds in a joint checking account that includes the paychecks of your spouse who is not involved in the debt?

Yes. Creditors cannot seize bank accounts except by due legal process. Which entails filing a lawsuit, winning a judgment, executing the judgment against the debtor's nonexempt property. The defendant is given an opportunity to claim exempted property before the judgment is rendered. A summons should never be ignored. Not appearing to defend a suit results in automatic default for the defendant.
