Umm, it depends on what the insurance company requires. In most cases the company will issue the check to the body shop and not to you. That way they can make sure you don't claim the same damage twice. If they make it out to you, then you are free to what you want with it but keep in mind it would just be wise to fix all the damages now anyway.

For damages from storms or weather related issues, sometimes from accidents such as your neighbor's tree limb crashing onto it, although it some cases it might be the neighbor's responsibility. If you do not maintain your home will insurance cover water damages?

Home insurance is not designed to act as a warranty and does not cover maintenance issues. If you fail to maintain your property and you experience a loss because of wear and tear, your insurance policy will not pay. Water damage losses are very complex in terms of home insurance. If a leaky pipe that has consistently gotten worse over time causes damage, the water loss will not be covered. On the other hand, if a sudden burst of water causes damage, the damage may be covered if the inspection proves the loss was sudden and not caused over a period of time.

Will homeowner's insurance cover an overflow toilet?

No. Homeowners insurance does not provide coverage for routine expected plumbing maintenance issues. However, If you have "Accidental Water Discharge" coverage on your policy, then you will be covered for resulting damages from the overflow but not for the actual plumbing repairs needed. If you have damages that resulted from the overflow, once you have made the required plumbing repairs the company will invoke the damage coverage. If you do not make the necessary plumbing repair then the insurance company will not fix the other damages that resulted from it. The reasoning is that if the homeowner refuses to maintain the home, then this is a moral hazard (negligence) on the part of the homeowner and the damages that result from lack of maintenance will be ongoing.

Will the insurance company pay for the damages caused by their driver if the injured victim is driving unlicensed and the car has been totaled?

Let's see if I can follow this. Insurance company A is at fault because of actions caused by driver A. Driver B who is not at fault is injured, but is unlicensed, and Auto B has been totalled. Insurance company A is going to have to pay damages to Driver B for property damage as well as for injuries because Driver A is deemed at fault. The fact that Driver B is unlicensed is a non-moving violation and Driver B will have to pay a substantial fines for these issues.

Am I required to use insurance money to replace roof?

Insurance companies grant money to correct issues from claims. If a person receives money to replace a roof from an insurance company, the money should be used for the repair. If a person decides to not use the money to replace the roof, there could be issues selling the home. The value of the home could decrease. Another issue a person may encounter is the risk of other damages resulting from the roof not being repaired. The insurance company may not cover damages to the home as a result of the roof not being replaced.
