Added: Question is unclear. Do you mean that a car going the same direction you are, has pulled up on YOUR right side? If so, wait and see what his intentions are before you turn. Don't assume you have the right of way.
If you mean that there is stopped traffic in the lane on the street you intend to turn into, you can either wait for the traffic to clear, or you may have to continue on to the next intersection and go around the block.

In California, you can make a right turn on red from the right-most lane, after coming to a complete stop and checking to make sure that there is no oncoming traffic. But look for signs; in some cases, there are signs prohibiting right turns on red lights.
Also; in California, you can generally make a left turn on red from the far-left lane, from a one-way street to another one way street. The key is, you're not supposed to cross any other lanes of traffic.
