This seems simple enough to me. If the second marriage was invalidated by a court then the marriage is null and void. But if the court has no notion of the invalidity of the second marriage you must file for divorce.

Polygamy is actually a punishable offence, so you may want to be careful how you go about it.

If you are married to a man in Texas and get married to another man in Louisiana before your divorce from the Texas man is final what is your status?

If you marry a man in Texas, you are married to that man until your divorce is final. So if you try to marry a man in Louisiana before your Texas divorce is final, the second marriage is invalid. In order to get a marriage license, you have to state that you are not already married. If you are, then you lied on the application, which will invalidate the license. You could also be charged with the crime of bigamy. You will have to marry him again after the Texas divorce is final if you want to be married to him.

Does a legal marriage have precedence over a common law marriage?

Not if you live in a state that recognizes common law marriage. In that case the common law marriage is a legal marriage. Whatever marriage comes first has precedence. Whatever marriage comes after is invalid. You can only be married to one person at a time in the United States. Can you press charges for bigamy after the divorce or should you do it before or during the divorce?

If your "spouse" married you knowing that he/she was already married your marriage is invalid and they committed bigamy. You don't need to obtain a divorce. You should make an appointment with your local district attorney's office to discuss your situation. They will advise you. You should act immediately to protect your assets and report the situation to the authorities. If your "spouse" married you knowing that he/she was already married your marriage is invalid and they committed bigamy. Is a marriage in CA legal if she was still married in CO?

Absolutely not. You can only be legally married to one person in the United States. You must obtain a divorce before you can remarry. The California marriage is invalid and she may face criminal charges if the matter is pursued by the "groom" especially if there was any ulterior motive.

It depends on the state you live in and whether the common law marriage was recognized under state law. If it was then he needs to get a divorce from his first wife and you are not legally married.

Is your second marriage valid if your first marriage was not final?

Yes. Your present marriage would be invalid if it took place before the divorce was finalized. You should arrange for the marriage to be performed once again. Until you do you cannot enjoy all the legal benefits that are bestowed upon people who are legally married, especially inheritance.
