No. A judge may be willing to consider a child's request but doesn't have to honor it. The court will make that decision. The child cannot make their own choice until they reach eighteen years old.

If the parent can not or will not pick up the child then there is nothing legally wrong with it. It becomes an inconvience to pack up the child and everything for nothing, but it is not illegal in any form.
