An officer never has to have a warrant for this test. They must have reason to believe you have been drinking or your permission. The officer seeing you moving goofy or smelling alcohol is reason enough. A blood test may need a warrant at times.

Whats the main differences between arrest with and without a warrant?

Without a warrant you must find reasonable grounds to arrest someone, whereas with a warrant your reason to arrest the suspect already exists. Without a warrant a Police Officer can arrest anyone without permission of a Magistrate as long as they follow the correct procedures so their arrest is lawful, which is unlike an arrest with a warrant where you must be granted the warrant to be able to arrest that person. Without a warrant, a Police Officer can mess the arrest up and make it an unlawful arrest but with a warrant it is very unlikely that they make it an unlawful arrest.

When may an officer make an arrest without a warrant?

When he has probable cause to believe that the person he is arresting has committed, or is about to commit, a criminal offense.

Can an officer take a person in custody without a custody order?

CUSTODY or make an arrest? What do you mean by custody? If he is picking somebody up it requires a judges order (warrant), and for a judge to sign a warrant, the police have to provide the judge with probable cause. An officer can make take someone into custody if a probation officer reports a probation violation or if the officer witnesses the person committing the crime. If an office doesn't follow proper procedure, has to answer to the court as to why he did what he did. There are checks and balances that help prevent violations of these rules, in most cases.

Do the officer need to show the warrant?

No, if law enforcement officers reasonably believe that a valid warrant has been issued, the officers may begin the search. The warrant does not have to be with them, and the warrant does not have to be given to the owner.

What is a fugitive from justice without a warrant charge?

This is not stating the type of charge he/she has, this just means that the person was detained and arrested because there is an active warrant out for the person outside of the state that they were arrested in. Here is an example of your question. A man owes child support in Michigan, failed to make payments, and now there is a warrant out for him. He no longer lives in Michigan and moved to Tennessee. He got pulled over for speeding in Tennessee and the police officer checked to see if there were any warrants, and there was a warrant issued from Michigan for failure to pay child support. So, the Tennessee Officer arrested him, and the reason for his arrest was "fugitive from justice without a warrant."

Is it legal to make passengers take a breathalyzer if the driver blows zeros?

In most places, it is not legal to make passengers take a breathalyzer if the driver blows zeros, as passengers are not typically required to submit to a breathalyzer test unless they are suspected of driving under the influence. Each jurisdiction may have specific laws regarding this, so it is best to consult local regulations for accurate information.
