The Judicial Branch has the final say on all laws. If a law is brought to them, they decide if it is constitutional or not.
executive branch, judicial branch, and legislative branch
If the legislative branch does not agree with the way in which the judicial branch has interpreted the law, they can introduce a new piece of legislation, and the process starts all over again.
The Framers believed that separation of powers and checks and balances were essential to protect the rights of the people. They had to decide which powers to give to each of the branches of the national government, and how to give each branch ways to check the powers of the other branches. Today we will learn about the problems the Framers had in deciding how much power to give to the executive and judicial branches. We will also learn how they provided ways these branches could check the power of the legislative branch. Finally we will learn about the special system they established for the election of the President.
No, Not at all!
The Legislative and Judicial are both checked in their own ways. Legislation can be vetoed and people to the Judicial branch must be appointed( and confirmed).

The Constitution limits the powers of government by creating the three branches, executive, judicial and legislature, all of which check the power of each other.
The branches of government are called branches due to the way the flow of power is generally diagrammed. We, the people, the the source or root of the power and we empower the government in three main ways. Those are the branches.
There are 2 main political parties in the US, the Republicans and the Democrats. The Democrats are in charge of the Executive Branch. In the Legislative Branch, there are 2 houses, the House of Representatives and the Senate. In the House of Representatives the Republicans have control, but in the Senate the Democrats have control. In the Judicial Branch there are 4 accepted conservatives (republicans) and 3 accepted liberals (democrats) the remaining 2 vote both ways; so it can be said that Republicans have the judicial branch.
