well, if it dosn't touch, then it isn't an ipod touch! i would either take it to an apple retail store close to you (you can find where they are on the internet) and ask them to either fix it or replace it. They definitely will replace it if when you go it is within 90 days of purchase or if you have extended your apple care plan for extra money. If it is not within your apple care expiry then I would still go to an apple store and see what they say

( i-pod 1,2,3,4) touches like silver and can scratch easily and is cold a lot ( i-pod 5) i had it for 5 month's and it never got scratched it feels about .1 lbs it is very cool to carry!
