No. In fact you could distill such alcoholic beverage on your own backyard for that matter, but you cannot name it as "tequila": there is an international classification system known as Designation of Origin (DO) which states the quality and geographical origin of such beverages. This classification is made to differentiate the cheap, low-quality brands from premium brands made of the "right stuff".

For example, Herradura and Don Julio are two of the best brands of tequila; both are made exclusively in Jalisco, Mexico due to their DO. On the other hand, you have Sauzaand Hornitos Reposado, which no longer keep the "tequila" denomination as they don't have all the required "ingredients" and/or are made outside of the delimited DO area.

Yes. Denomination of origin states that any by-product of agave plant fermentation has to be made in Mexico to be called tequila. Otherwise, it cannot have such word on its brand.
