Not if they work for the government on salary. Some "public defenders" are actually private attorneys who defend indigents as private contractors, rather than on salary. They are free to do what they please.

∙ 14y agoUnder unusual circumstances I suppose they could. HOWEVER - Public Defenders are government employees (just like the prosecutor) and paid by tax money. They wuld have to justify the expenditure of their Office's budgeted tax money in order to hire one. I can't say that this would never happen but it would be pretty unusual for it to occur.

When should a Judge appoint a Public Defender?
In California, public defenders are assigned by the judge during the defendant's first court appearance, which is called an arraignment. Public defenders are only assigned to defendants who can't afford to hire a lawyer, so the defender has to complete a financial form. If the judge or the public defender determines that the defendant can't afford a lawyer, the judge will assign a public defender at that time. However, it is possible to obtain the services of a public defender before the arraignment. If the defendant is being questioned or put in a lineup, and can't afford a lawyer, the police will arrange for a public defender to be present, or allow the defendant to call the Public Defender's Office. In Texas - or any other state - you can't change your public defender if you don't think he is doing a good job. Only the judge can change your public defender, so you would have to convince the judge that the public defender is not doing a good job. If you did not do it, don't plea to it. Do you have a good lawyer? If you have a public defender, you will be told to plea. My advice is to spend thousands for a good defense lawyer that specializes in cases like yours. If you get a run of the mill lawyer, you'll get a run of the mill defense. DA's are relentless and will not give up, so neither should you. A DA's worst fear is a jury!
